These Candidate Screening Terms (the "Candidate Terms") govern your access to and use of the assessment ("Assessment") provided to you ("you" or "your") by your potential employer (the "Potential Employer").
BY CLICKING THE "ACCEPT" BUTTON OR BY STARTING THE ASSESSMENT, YOU AGREE TO THESE TERMS.

Purpose. The Assessment is provided to support the Potential Employer's recruitment or evaluation process. Advance Together AI Incorporated ("Provider") is not the employer, does not make hiring decisions, and does not guarantee any outcome.

Permitted Use. You may use the Assessment only for your own participation in the Potential Employer's process. You will not: (a) copy, record, screenshot, publish, or share any Assessment content; (b) attempt to access anyone else's Assessment; (c) interfere with or disrupt the Assessment; or (d) use automated tools or artificial intelligence to complete the Assessment.

Consent. YOU AUTHORIZE PROVIDER TO COLLECT, USE, STORE, AND DISCLOSE YOUR RESPONSES AND RELATED INFORMATION (INCLUDING TECHNICAL DATA SUCH AS DEVICE AND LOG INFORMATION) TO DELIVER THE ASSESSMENT AND PROVIDE RESULTS TO THE POTENTIAL EMPLOYER. IF THE ASSESSMENT INCLUDES AUDIO/VIDEO RECORDING OR OTHER SPECIAL DATA COLLECTION, YOU CONSENT TO THAT COLLECTION AS PRESENTED TO YOU DURING THE ASSESSMENT.

In connection with this Assessment, the Potential Employer collects, and Provider processes on the Potential Employer's behalf, information about you, which may include your responses, results, and technical information, and other personal information. The Potential Employer collects this information for its screening and evaluation purposes. Assessment Content. No rights are granted to you except the limited right to complete the Assessment.

DISCLAIMERS. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE ASSESSMENT IS AT YOUR OWN RISK. THE ASSESSMENT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW, PROVIDER DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE EXTENT THAT APPLICABLE LAW DOES NOT ALLOW THE EXCLUSIONS PROVIDED FOR IN SECTION 6, THE EXCLUSIONS IN SECTION 6 SHALL NOT APPLY TO YOU TO THE EXTENT PROHIBITED.

LIMITATION OF LIABILITY. TO THE EXTENT PERMITTED BY APPLICABLE, UNDER NO CIRCUMSTANCE WILL PROVIDER OR ITS PARENT, SUBSIDIARIES, AFFILIATES OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS OR SUCCESSORS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, EXEMPLARY, SPECIAL, AGGRAVATED OR PUNITIVE DAMAGES, OR FOR LOSS OF OPPORTUNITY, LOSS OF INCOME, OR REPUTATIONAL HARM, ARISING FROM OR RELATED TO THE ASSESSMENT. IN NO EVENT WILL PROVIDER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE ASSESSMENT UNDER ANY LEGAL OR EQUITABLE THEORY, INCLUDING BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE EXCEED THE ONE DOLLAR IN LAWFUL CURRENCY OF CANADA ($1 CAD). IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSIONS PROVIDED FOR IN THIS SECTION, THOSE EXCLUSIONS SHALL NOT APPLY TO THE EXTENT PROHIBITED.
TO THE EXTENT THAT APPLICABLE LAW DOES NOT ALLOW THE LIMITATIONS OF LIABILITY PROVIDED FOR IN THIS SECTION 7, THE LIMITATION WILL NOT APPLY TO THE EXTENT PROHIBITED.

Artificial Intelligence. This Assessment uses automated and artificial intelligence-based processing to administer and evaluate your responses. Your results may inform a decision made by the Potential Employer.

Questions. Questions about the role, hiring process, or decisions should be directed to the Potential Employer.

Governing Law. These Candidate Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein and notwithstanding your domicile, residence, or physical location. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods (CISG) and Ontario's International Sales Convention Act, RSO 1990, c I.10 do not apply to this Agreement. The parties irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario for any actions, suits, litigation or proceedings arising out of or relating to the enforcement of these Candidate Terms.
